Every Sebastian yard seems to have one. The oak that drops a ton of leaves into the gutters. The pine that leans a little closer to the house every year. The palm that makes you nervous when the wind picks up.
If you live inside Sebastian city limits, the city has rules about taking trees down. They are not hard. But the city wants to see the tree before it comes down, and it can require you to plant replacement trees. Here is the plain version.
Which trees need a permit in Sebastian
The city's tree protection rules are in Article XIV of the Sebastian Land Development Code. The city's tree ordinance brochure sorts trees into a few groups.
- Protected trees: any tree 4 inches or more in diameter, measured at 4.5 feet above the ground. Scrub oaks count once their base is 1.25 inches or more across. Removing a protected tree takes a permit.
- Specimen trees: any tree 10 inches or more in diameter, all red and black mangroves, and palms other than sabal palms. A sabal (cabbage) palm counts as a specimen tree once it has 6 feet or more of clear trunk. Specimen trees also need a permit, and the application form flags specimen removals for separate review.
- Historical trees: any tree the City Council has named by resolution.
- Nuisance trees: the brochure lists earpod, chinaberry, Australian pine, punk (cajeput) and Brazilian pepper as prohibited species that may not need a permit. The city still asks you to contact it for approval first.
Quick tip on measuring: wrap a tape measure around the trunk at about chest height (4.5 feet) and divide by about 3.14. A trunk that measures 13 inches around is roughly 4 inches across, which is the line for a protected tree.
How the permit works and what it costs
The residential tree removal application asks for your address and lot size, who is doing the work and their cost estimate, and why the tree is coming out. You also draw a simple sketch of your lot showing the house, the driveway, the trees you want to remove and the trees you are keeping, with each tree's trunk size and type.
- Fee: $25, non-refundable. It pays for the inspection.
- Where to apply: online through the Building Department's permitting system, or in person at City Hall, 1225 Main Street.
- Inspection first: city staff visit the property before the permit is issued. Mark the trees clearly and make sure the inspector can get to them.
- Post it: a copy of the permit has to be posted on site before the work starts.
- Close it out: after the tree is gone, call the city at 772-589-5537 to schedule the final inspection so the permit is closed.
- HOA: by signing the form, you confirm the work has your homeowners association's approval if you have one.
If a contractor applies for you, the form asks for a copy of your signed contract with them.
Will I have to plant new trees?
Maybe. Sebastian requires a minimum number of trees on each residential lot. If taking a tree down drops you below that number, the application says replacement trees are required. The brochure's table is based on lot size:
- Under 10,000 square feet: 5 trees.
- 10,000 to 15,999 square feet: 7 trees.
- 16,000 to 19,999 square feet: 12 trees.
- 20,000 to 29,999 square feet: 15 trees.
- 30,000 to 39,999 square feet: 18 trees.
- 40,000 square feet or more: 20 trees.
Bigger existing trees count for more. A tree 2 to 5 inches across counts as 1, over 5 to 10 inches counts as 2, over 10 to 20 inches counts as 3, and over 20 inches counts as 4. Palms count one for one. New trees must be at least 8 feet tall with a 1.5-inch trunk, and Florida Grade 1 or better. Palms can make up no more than 35% of the total. The brochure suggests natives like live oak, bald cypress, red maple, slash pine, southern magnolia and cabbage palm.
The state exemption for dangerous trees
Florida Statute 163.045 sets one big exception. On a single-family home lot, a city cannot require a notice, application, permit, fee or replanting to prune, trim or remove a tree if the owner has documentation from an ISA-certified arborist or a Florida-licensed landscape architect. That documentation must show the tree poses an unacceptable risk, as defined by the International Society of Arboriculture's risk assessment standards.
Two things to know. Your own opinion that a tree looks scary does not count; the paperwork has to come from one of those two professionals. And the exemption does not cover mangroves, which have their own state protections.
What to do before you cut
- Confirm your home is inside Sebastian city limits. If it is in unincorporated Indian River County, the county's rules apply instead.
- Measure the trunk at 4.5 feet. If it is 4 inches or more across, plan on a permit.
- Count the trees left on your lot after removal and compare to the table above, so a replacement requirement does not surprise you.
- If you think the tree is dangerous, get a written risk assessment from an ISA-certified arborist before you apply. Keep it with your house papers.
- Check with your HOA if you have one.
- Hire a licensed, insured tree service, and make sure the permit is issued and posted before anyone starts.
